ORDINANCE No 315
AN ORDINANCE REGULATING OUTDOOR BURNING WITHIN THE BOROUGH OF SPRING CITY, SPECIFYING WHEN SUCH BURNING MAY BE DONE AND UNDER WHAT CONDITIONS, AND SETTING FORTH PENALTIES FOR VIOLATION OF THE ORDINANCE.
BE IT ORDAINED AND ENACTED by the Mayor and Council of the Borough of Spring City and it is hereby ordained and enacted by authority of the same as follows:
SECTION 1. It shall be unlawful to light or maintain any fire out of doors anywhere in the Borough of Spring City, for the purpose of burning rubbish, leaves, trash, or any other items of waste material of any type whatsoever, except that such burning may be done during daylight hours of Wednesday and Saturdays only, and no other day of the week. All such fires shall be extinguished prior to sundown.
SECTION 2. During the Wednesday and Saturday hours during which burning is allowed, burning of paper, excelsior, or other materials which may be blown about by the wind shall be burned only in a stove, fireplace, furnace, incinerator, or can or drum which have wire or grating sufficiently fine to prevent the escape of ignited particles.
SECTION 3. No burning of any sort shall be done within fifteen (15) feet of any existing building or structure.
SECTION 4. During all burning there shall be a competent person present.
SECTION 5. This Ordinance shall not be construed to bar outdoor cooking through the use of grills, barbecues, pits, hibachis and similar cooking equipment.
SECTION 6. It shall be unlawful to burn garbage, tires, fly ash, oily rags, or any other air contaminants, which, for the purpose of this Ordinance, shall be construed to mean and include, but not be limited to, anything that causes soot, dust, cinders, dirt, noxious or obnoxious acids, fumes, gases, vapors, or odors, to be discharged into the air.
SECTION 7. For the purposes of this Ordinance, the hours of daylight shall be construed to be the time between sunrise and sunset, and the time of sunrise and sunset as set forth in any newspaper of general circulation in the Spring City area shall be prima facie evidence, Such evidence may be overcome by an official document obtained from the Weather Bureau, United States Department of Commerce, of any other official government agency.
SECTION 8. Any person violating this Ordinance shall, upon conviction, thereof, before a District Justice, be sentenced to pay a fine of not more than Three Hundred ($300,00) Dollars and costs of prosecution, and in default of payment thereof, to imprisonment for not more than thirty (30) days in the Chester County Prison.
SECTION 9. All Ordinances or parts of Ordinances inconsistent herewith are hereby repealed.
